Mr. Das, learned advocate appears on behalf of petitioner and submits, prayer is for recall of order dated 1st December, 2021 made by this Bench, disposing of W.P.(C) no.35819 of 2021. He submits, his client was not represented. The order was ex-parte. 2.
It is true that in the civil proceeding his client (wife) was precluded from filing written statement (w/s) but, thereafter, the proceeding itself was dismissed. On restoration, his client appeared through another learned advocate and filed w/s with petition for acceptance, as would appear from order dated 30th August, 2019. By subsequent order dated 4th April, 2022, the written statement stood accepted.

Mr. Kar, learned advocate appears on behalf of writ petitioner (husband) and submits, copy of the w/s was not served. Mr. Das replies that copy will be served in course of the day. 4.
The review petition is allowed. Order dated 1st December, 2021, disposing of the writ petition is recalled. Mr. Das, prays for return of original certified copies of the order-sheets annexed to the review petition on production of true photocopies thereof. 5.
Registry is directed to return the original certified copies on submission of true photocopies. The writ petition be listed before the Bench having assignment.
