Heard learned counsel for the Parties.

This matter was earlier heard on 28.10.2022 and was posted to today providing opportunity to the learned State Counsel to find suitable response. Today on the basis of instruction memo, learned Additional Government Advocate submits, there have been some developments but the issue could not be materialized for non-submission of Form-A by the Executive Engineer, Rural Works, Nayagarh. Mr.Ghosh further submits, the final outcome on the request of the Petitioner is dependent on the submission of Form-A by the Executive Engineer, Rural Works, Nayagarh. Suitable direction ought to be issued to the Executive Engineer concerned.

Considering the technical difficulty in not completing the required exercise, without further wastage of time by keeping the matter pending, this matter stands disposed of directing the Executive Engineer, Rural Works, Nayagarh to complete all the required formalities even in providing the required Form-A to the D.F.O., Nayagarh, O.P.2 at least completing the entire exercise within fifteen days from the date of communication of this order. As a consequence of necessary compliance by the Executive Engineer, Rural Works, Nayagarh, the D.F.O., O.P.2 shall complete his part at least within a further period of three weeks from the date of such compliance.

Registry is directed to communicate this order to the Executive Engineer, Rural Works, Nayagarh, as furnished in the Memo so filed in Court by the learned counsel for the Petitioner, at the cost of the Petitioner.
