Heard learned counsel for the Parties.

Considering the grounds stated in the Writ Petition, argued herein and looking to the observations of the trial court in declining to entertain the proceeding under Section 15(b) of the O.S.S. Act, 1958, and for there is involvement of a controversy required to be adjudicated by the competent civil court, this Court is of the opinion that the competent authority taking up the issue in Annexure-7 for correction of the Record of Right has as rightly disallowed the proceeding under Section 15(b) of the O.S.S. Act. In the circumstance this Court finds no reason to entertain the Writ Petition. 4.
The Writ Petition stands dismissed. Dismissal of the Writ Petition shall however not stand on the way of the Petitioners to raise a civil dispute to score the dispute for their purpose. (Biswanath Rath) Judge Swarna
