It is agreed by learned Counsel for the Parties that the case of the petitioner is covered by the judgment of the apex Court in the case of Union of India v. B.M. Jha, (2007) 11 SCC 632. 4.

In the above view of the matter, this writ petition stands disposed of directing the opposite parties to consider the case of the petitioner in the light of the judgment of the apex Court in the case of B.M. Jha (supra).
