05. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard Mr. S.K. Das, learned counsel for the Petitioner and Mr. M.K. Balabantaray, learned Standing Counsel for the StateOpposite Parties.

3. The Petitioner has filed the present Writ Petition with the following prayer:- "(i) Quash the notice for termination of service under Anx. 9 with all consequential benefits.

(ii) Pass any other relief(s) the Hon'ble Tribunal deemed fit and proper".

4. It is submitted that similar issue has already been decided passed by this Court vide judgment dated 03.12.2021 in WPC(OA) No.923 of 2015. In the said judgment, this Court while dealing with similar issue has already quashed the impugned orders under Annexures-13, 13/1 and 13/2 and the Petitioners therein have been allowed to continue as before with all service and financial benefits.

5. Learned Standing Counsel also fairly submitted that similar issue has been dealt with by this Court in WPC (OA) No.923 of 2015.

6. In view of such order passed by this Court in the aforementioned case, the present Writ Petition is also allowed by quashing the impugned orders under Annexure-9.

7. Since it is submitted that by virtue of the interim order passed on 31.03.2015, the Petitioner is continuing, he shall continue as such with all service and financial benefits.
