This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in connection with G.R. Case No.9 of 2022(N), pending in the file of the learned Additional District & Sessions Judge, Kodala, arising out of Kabisuryanagar P.S. Case No.430 of 2022, for alleged commission of offences under Section 20(b)(ii)(B)/29 of the N.D.P.S. Act. 4.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Additional District & Sessions Judge, Kodala, Ganjam, by order dated 11.10.2022 in the aforementioned case, the present BLAPL has been filed. 5.

Perused the order of rejection.

Admittedly since the quantity of the contraband (Ganja) is to the tune of 9Kgs 250gms which is less than the commercial

quantity as prescribed, this Court directs the petitioners to be released on bail on such terms to be fixed by the Court in seisin over the matter.

While releasing the petitioners on bail, the learned court in seisin over the matter shall verify assertion regarding criminal antecedent of the petitioners. If it comes to the fore that the petitioners have any criminal antecedent, this order shall stand recalled.

Accordingly, the BLAPL stands disposed of.
