This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with T.R. Case No.50 of 2022, pending before the Court of learned Additional Sessions Judge-cum-Special Judge, Koraput, arising out of Machhkund P.S. Case No.43 of 2022, for alleged commission of offences under Section 20(b)(ii)(C) of NDPS Act. 4.
Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Judge, Koraput, by order dated 11.10.2022 in the aforementioned case, the present BLAPL has been filed. 5.
Since the consideration by the learned Court in seisin over the matter was during the course of investigation, it is not apposite to consider this bail application at this stage.

Learned Court in seisin over the matter is called upon to consider the matter afresh after filing of charge sheet, which shall be considered on its own merits.

Accordingly, the BLAPL stands disposed of.
