This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in 1 CC No.01 of 2005, pending in the file of learned J.M.F.C., S.Rampur, for commission of alleged offence under Sections 307/34 of IPC. 4.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Sonepur by order dated 10.10.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the statement of the injured Trilochan Tandi in 1 CC Case No.1 of 2005 and also the rejection order. 6.

Keeping in view the specific overt act attributed to Petitioner No.2-Ramesh Barik, this Court is not inclined to entertain the bail application vis-à-vis the said Petitioner and the bail application of Petitioner No.2 stands rejected at this stage.

Taking into account the general allegations qua Petitioner No.1, this Court directs the Petitioner No.1 to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
