Petitioner No.1 is stated to have availed a loan of Rs.3 Lakhs on 12th September, 2019 from Utkal Grameen Bank, Polasara Branch, District-Ganjam, wherein Petitioner No.2 had offered his immovable property as a collateral security. The loan account having been classified as NPA and recovery process initiated under the SARFAESI Act, 2002 (for short, "the Act, 2002").

The petitioner in the instant Writ Petition had laid challenge to the order dated 7th October, 2022 passed by the District Magistrate, Ganjam on an application under Section 14 of the Act, 2002 moved by the Bank, whereby official assistance has been directed to be provided for taking over actual physical possession of the secured asset.

At the outset, Mr. J. Sahoo, learned counsel for the petitioner states that in view of the settlement and the loan account having been closed, the petitioner wants to withdraw the present Writ Petition as not pressed. He also files a memo which is taken on record.

In view of the above, the present Writ Petition stands dismissed as not pressed.
