The Original Application No.4612(C) of 2016 was filed before the Odisha Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC(OAC) No.4612 of 2016. 3.
The Petitioner, who is an aspirant for the post of Assistant Section Officer, pursuant to advertisement No.08 of 2012-13 issued by the Opposite Party No. 2, namely, Special Secretary, Odisha Public Service Commission, has challenged the inaction of the Opposite Party No. 2 in not considering the case of the Petitioner for appointment on the ground that the cut off mark fixed by the Opposite Party No. 2 is 348.817 in respect of SEBC (male) category, whereas the Petitioner has secured 223.944. It is the case of the Petitioner that he has done well in the written examination and sought for supply of copy of the answer
// 2 // paper by making an application to the proper authority under the Right to Information Act but the same has not been supplied to him. 4.
Learned counsel for the Petitioner submits that he has no up-to-date instruction in the matter.

Mr. L. Samantaray, Addl. Govt. Advocate submits that by efflux of time, the writ petition has been rendered infructuous. 6.
