1. Heard learned counsel for the Petitioners and learned counsel for the State.
2. This is an application for bail U/s.438 Cr.P.C. filed by the Petitioners in apprehension of arrest for their alleged involvement in the offences under Sections 366/509/506/342/376(2)(n)/120(B) of IPC.
3. Learned counsel for the State submits that the up-to-date case diary obtained includes the statement of the victim recorded U/s. 164 Cr.P.C. The statement of other witnesses annexed to the case record clearly implicates the Petitioners in the kidnapping and giving assistance to the Principal accused Bisikeshan Naik whose whereabouts is yet to be ascertained.
4. Keeping in view the submission of the parties, the nature of allegations as emerged from the materials on record, the
// 2 // circumstances appearing, the seriousness and gravity of the offences, this court is not inclined to grant anticipatory bail to the Petitioners. Accordingly the prayer for bail stands rejected and the ABLAPL is dismissed.
