This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 22.09.2021 in connection with Kiakata P.S. Case No. 09 of 2020 corresponding to G.R. Case No.93 of 2020 pending in the Court of learned S.D.J.M., Athmallik for the alleged commission of offence under Section 395 of IPC. 4.

The allegation is that the present petitioner along with four other culprits tried to snatch away a gold chain, which the wife of the informant was wearing but could not succeed. 5.

Having regard to the nature of allegations, materials on record and the period of detention already undergone as also the fact that the petitioner appears to have been implicated in the case solely on the basis of the statement of the co-accused, I am inclined to allow the prayer for bail. Let the petitioner be

released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail. 6.

BLAPL is accordingly disposed of.
