This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 04.08.2021 in connection with Chauliaganj P.S. Case No.271 of 2021 corresponding to G.R. Case No.942 of 2021 pending in the Court of learned J.M.F.C. (City), Cuttack for the alleged commission of offence under Sections 394/413/34 of IPC. 4.
It is submitted that the petitioner has been entangled in this case without any evidence and moreover no T.I. parade was conducted during investigation.

Learned Addl. Standing Counsel on the other hand opposed the prayer for bail by submitting that the petitioner is a habitual offender having several cases against him. 6.
Having considered the rival submissions, materials on record, the period of detention already undergone and the fact
that the co-accused persons have already been released on bail, as submitted by learned counsel for the petitioner, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail. 7.
BLAPL is accordingly disposed of.
