This matter is taken up through hybrid mode.

The Petitioners in this CMP seek to assail the maintainability of the execution proceeding in Execution Case No.50 of 2018 pending before learned Senior Civil Judge, 1st Court, Cuttack.

Since the Petitioners have a remedy under the Code of Civil Procedure, 1908, this Court is not inclined to entertain this CMP.

Accordingly, this CMP stands dismissed.
