This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Additional Government Advocate.

The Petitioner has filed this writ petition with the following prayer :

"In the premises, therefore, it is humbly prayed that the Hon'ble Court may graciously be pleased to direct the O.Ps to implement their order dated 13.04.2022 accordingly to regularize the service of the Petitioner and give all consequential benefits at earliest.

And further be pleased to pass any other appropriate order/orders as deemed fit and proper under the facts and circumstances of the case for ends of justice."

It is submitted by the learned counsel for the Petitioner that the Engineer-in-Chief Water Resources, Odisha, Bhubaneswar has recommended for regularization of service of 18 numbers of Work Charged employee including the name of the present Petitioner,

// 2 // however, no action has been taken. Learned counsel for the Petitioner submits that let the Petitioner approach the Opposite Party No.1 by filing a representation along with a copy of the letter dated 03.09.2022 under Annexure-5 and in the event the Petitioner approaches the Opposite Party No.1, the Opposite Party No.1 may be directed to consider the case of the Petitioner in the light of the law laid down by the Hon'ble Supreme Court as well as this Court. 6.

In view of the aforesaid limited nature of grievance of the petitioner, this Court disposes of the writ petition at the stage of admission granting liberty to the Petitioner to file a fresh representation along with all supporting documents and copy of the letter under Annexure-5 before the Opposite Party no.1 within a period of two weeks from today. In the event such representation is filed, the same shall be considered taking into account the law laid down by this Hon'ble Court and the recommendation of the Engineer-in-Chief, Water Resources and letter dated 03.09.2022 under Annexure-5 and shall be disposed of by passing a speaking and reasoned order within a period of six weeks from the date of filing of representation.

With the aforesaid observation the writ application stands disposed of.

Urgent certified copy of this order be granted on proper application.
