1. This matter is taken up through hybrid mode. Order No.

2. Heard Mr. B.P.Das, learned counsel for the Petitioners, Mr.S.K.Mishra, learned Addl. Standing Counsel for the State and Mr. M.K.Pati, learned counsel appearing for the informant.

3. The Petitioners are in custody since 28th September, 2021 in connection with Jakhapura P.S. Case No.111 of 2020 pending in the court of learned J.M.F.C., Jajpur Road, Jajpur corresponding to C.T. Case No.1865/2020 for the alleged commission of the offence under Sections 341/294/323/307/325/109/506/34 of I.P.C.

4. It is submitted by the learned counsel for the Petitioners that some of the co-accused persons, who stand on similar footing have been granted bail by this Court.

5. Learned Addl. Standing Counsel for the State, on the other hand, has opposed the prayer for bail by submitting that if the Petitioners are released, they may commit similar offence. Learned counsel appearing for the informant has also opposed the prayer for bail by submitting that there are criminal antecedents of the Petitioners.

6. However, considering the submissions made, the materials on record, the period of detention already undergone and the fact that the co-accused persons namely, Prasanjit Nayak @ Chintu and Bikram Bihari Bramha have already been released on bail, I am inclined to allow the prayer for bail.

7. Let the Petitioners- Sourav Ranjan Nayak, Smruti Ranjan Bramha and Suresh Mallik be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case.

8. The BLAPL is disposed of.

9. Urgent certified copy of this order be granted on proper application.
