This matter is taken up through Hybrid Arrangement (Video Conferencing/Physical Mode).

None appears on behalf of the Petitioners when the matter is called.

The grievance of the Petitioners in the present writ petition is that they are not getting the retrial benefits as they are entitled to get as per law. It is further stated in the writ petition that the claim of the Petitioners is covered by a decision of this Court rendered in W.P.(C) No.6778 of 2021 vide order dated 28.09.2021 in the case of Basanta Kumar Das and others vrs. State of Odisha and others. 4.

In such view of the matter, the writ petition is disposed of with a direction to the Petitioners to approach before the Director, Secondary Education, Odisha, Bhubaneswar-Opposite Party No.2 by filing a fresh representation taking all the grounds available to them in support of their claims along with copy of the order passed in the

// 2 // case of Basanta Kumar Das and others vrs. State of Odisha and others (supra). If such a representation is filed by the Petitioners within a period of two weeks from today, the Opposite Party No.2 shall do well to dispose of the same in accordance with law by passing a reasoned and speaking order within a period of twelve weeks from the date of filing of the representation by the Petitioners. The decision so taken on the representation of the Petitioners shall be communicated to them within a period of ten days thereafter. With the aforesaid observation, the writ petition is disposed of. Urgent certified copy of this order be granted on proper application.
