This matter is taken up through virtual/physical mode. 2.
The Original Application No. 1401 of 2015 was filed before the State Administrative Tribunal, Bhubaneswar. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OA) No. 1401 of 2015.

Heard Mr. C.S. Panda, learned counsel for the Petitioner and Mr. M.K. Khuntia, learned Additional Government Advocate for the Opposite Parties. 4.
The Petitioner has come up before this Court being aggrieved by the decision of Opposite Parties to the effect that the Government has proposed to take a decision to convert the post of Statistical Assistant from State Cadre Post to District Cadre Post.

The Petitioner submitted that the Women and Child Development Department has issued a letter dated 22nd April, 2015 vide Annexure-6 to exercise one-time option by Statistical Assistant for district encaderisation.

Mr. C.S. Panda, counsel for the Petitioner has stated that if the above option is exercised, his place in the gradation list shall be dislocated. He has challenged the same. 7.
Mr. M.K. Khuntia, Additional Government Advocate referring to final gradation list of Statistical Assistant working under Women and Child Development Department submitted that the date of birth is reflected in the said document being 20th October, 1961, the Petitioner would have been retired on attaining the age of superannuation in the meantime. Hence, the matter has been rendered infructuous.

In view of such submission, the writ petition is dismissed as infructuous.

In view of disposal of the writ petition, the interim order dated 10th June, 2015 passed by learned Odisha Administrative Tribunal stands vacated.
