Heard learned counsel for the Parties.

The Writ Petition involves the following reliefs:- "In view of the facts & submissions mentioned in Para-(6) above the applicant pray for the following relief (s):- (i) The Hon'ble Tribunal may be pleased to admit & allow the original application, (ii) The Hon'ble Tribunal be pleased to quash the impugned order for cancellation of RACP benefit dtd. 2.6.15 under Annexure-4, And/ Or (iii) The Hon'ble Tribunal be pleased to further direct that the applicants are eligible & entitled to get the RACP benefits on completion of 10.20.30 years of service by taking into account their initial date of appointment/ length of service but not from the date of acquiring training qualification along with all consequential service & financial benefits in view of the F.D. Resolution dtd.6.2.

2013 within a time bound period by holding that the sanction of RACP benefit as per Annexure-3(Series) is a correct & justified one for the interest of justice. (iv) The Hon'ble Tribunal may be pleased to pass any order(s)/ direction(s) as deems fit and proper and also impose the exemplary cost upon the respondent no-2 for the interest of justice.

Even though the matter is entertained in the year 2015 in the Tribunal and on transfer, the same is taken up hearing in 2022, no counter affidavit has been filed as of now. In the circumstance without further loss of time this Court disposes of the application directing the competent authority, Block Education Officer (B.E.O)-Opposite Party No.4 to treat the Original Application as representation and do the needful.

Copy of the order along with copy of the brief be served on Opposite Party No.4 by completing the entire exercise within a period of three months.
