2. Heard Mr. Sudarsan Behera, learned counsel for the Petitioner and Mr. P. Tripathy, learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 22nd August, 2021 in connection with Chandapur P.S.

Case No.119/2021 corresponding to Special G.R. Case No.111/2021 pending in the court of learned Special Judge, Nayagarh for the alleged commission of the offence under Sections 376/109/354

// 2 // (C)/354(D)/506/509/34 of I.P.C and Sections 12,15 and 17 of the POCSO Act and Sections 66(E)/67/67(A)/67(B) of I.T. Act.

4. Considering the fact that the Petitioner is not the principal accused, but had allegedly taken photographs during the occurrence, the period of detention already undergone and the fact that he is a permanent resident under Chandanpur P.S. in the district of Nayagarh, I am inclined to allow the prayer for bail.

5. Let the Petitioner- Umakanta Routray be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case.

6. The BLAPL is disposed of.

7. Urgent certified copy of this order be granted on proper application.
