This matter is taken up through hybrid mode.

This CMP has been filed assailing the order dated 8th April, 2022 (Annexure-7) passed by learned Civil Judge (Junior Division), Bargarh in C.S. No.4 of 2019, whereby an application under Order VII Rule 11 C.P.C. has been rejected. 3.

Since the Petitioner has a remedy under the Code of Civil Procedure, 1908 to assail the impugned order under Annexure-7, I am not inclined to entertain this CMP. 4.

Accordingly, this CMP stands dismissed.

Dismissal of the CMP shall not preclude the Petitioner to avail the remedy under the Code of Civil Procedure, 1908. (K.R. Mohapatra) Judge ms
