It is alleged that even in spite of clear direction in R.P. Case Order No.

No.428 of 2002, there is no conclusion of the Misc. Case No.48 of 2016 pending before the Tahasildar, Cuttack.

Considering the allegation made by the learned counsel for Petitioner, this Court observes, in the event there is no stay order operating involving the order passed in the R.P. Case No.428 of 2002, there should not be any inordinate delay in disposal of the Misc. Case No.48 of 2016. In the process this Court in disposal of the Writ Petition directs the Tahasildar, Cuttack to conclude the proceeding vide Misc. Case No.48 of 2016 by providing opportunity of hearing to the parties likely to be affected, within a period of two months from the date of communication of a certified copy of this order by the Petitioner.
