This matter is taken up through virtual/physical mode. 2.

The Original Application No.1335 of 2015 was filed before the Odisha Administrative Tribunal, Bhubaneswar. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OA) No.1335 of 2015.

None appears for the Petitioner.

The Petitioner has filed this writ petition stating that being appointed as Forester on 05.05.1971 got retired from service as Forester on 30.06.2006 and complains that he has not been paid his retiral benefit such as gratuity, leave salary, final pension and commuted value of pension. The Petitioner sought for a direction to the Opposite Party No.3 for disbursement of his dues. 5.

Mr. Khuntia, learned Additional Government Advocate for the State brought to the notice of this Court that the counter affidavit filed on behalf of the Opposite Party Nos.2 and 3, it has been categorically stated that since Vigilance case has been pending, the retirement benefits have not been granted in view of Sub-Rule 5(a) of Rule 49 read with Sub-Rules (1) & (2) of Rule 66 of the Odisha Civil Services (Pension) Rules, 1992.
