This matter is taken up through virtual/physical mode. 2.

The Original Application No. 43 of 2016 was filed before the State Administrative Tribunal, Bhubaneswar. After its abolition, the same has been transferred to this Court which is renumbered as WPC (TAC) No. 43 of 2016.

The Petitioner, working as Secretary of Salandi Gram Panchayat filed writ petition way back in the year 2001 for consideration of his promotion to the Post of Village Level Worker (V.L.V). Said writ petition was transmitted to the Learned Odisha Administrative Tribunal vide order dtd.24.06.2016 passed by this Court. Subsequently said case has been retransferred to this Court on abolition of the Odisha Administrative Tribunal.

Mr. L. Samantaray, Additional Government Advocate pointed out in the year 2001 that the Petitioner has mentioned his age as 49 years and by now the cause of action as claimed does not survive.

In view of such submission, the writ petition is dismissed as infructuous reserving liberty to the counsel for

// 2 // the Petitioner to revive within a period of 90 days, in the event any cause of action still subsists.
