1. This matter is taken up through hybrid mode. Order No.

2. Heard Mr.Manoranjan Acharya, learned counsel for the Petitioner and Mr. P. Tripathy, learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 19th September, 2021 in connection with Nayagarh P.S.

Case No.196/2021 corresponding to Special G.R. Case No.127/2021 pending in the court of learned Special Judge-cum-Sessions Judge, Nayagarh for the alleged commission of the offence under Sections 21(B)/29 of the NDPS Act.

4. The allegation against the Petitioner is that he along with coaccused persons were in possession of brown sugar intending to sell it. In so far as the present Petitioner is concerned, the brown sugar weighing 11 grams 570 milligrams was recovered from him. It is submitted that the co-accused persons have already been released on bail by this Court vide orders passed in BLAPL Nos.9067/2021, 9098/2021 and 9253/2021.

5. Considering the submissions as above, the materials on record, the period of detention already undergone and the fact that the similarly placed co-accused persons have already been released on bail, I am inclined to allow the prayer for bail.

6. Let the Petitioner- Titula @ Biswa Ranjan Jena be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case.

7. The BLAPL is disposed of.

8. Urgent certified copy of this order be granted on proper application.
