Learned counsel for the Petitioner claimed that for the Order No.

unauthorized occupation over the Government land by the private occupiers, the Petitioner is suffering a lot and therefore, a direction may be issued to the Estate Officer, General Administration Department to take a decision on the request of the Petitioner vide Annexure-1.

From the pleadings made in the writ petition and the plea taken in Annexure-1 a representation, it appears, the Petitioner has already lodged his protest before the Estate (Land) Officer, General Administration Department for taking appropriate action. 3.

Considering that the objection of the Petitioner is pending consideration of the Estate Officer, this Court without expressing any opinion on the claim of the Petitioner simply directs the Estate Officer, to first ascertain; if the complaint requires to be entertained under the provisions of the Orissa Public Premises (Eviction of Unauthorized

// 2 // Occupants) Act, 1972 and in the event the proceeding comes under the Orissa Public Premises (Eviction of Unauthorized Occupants) Act, 1972, the Estate Officer shall initiate appropriate proceeding and take decision, as appropriate, thereafter, but however involving the parties likely to be affected. The inquiry be completed within a period of one month and the proceeding, if initiated, should be concluded within a period of three months thereafter.
