This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard the learned counsel for the petitioner and learned counsel for the State as well as learned counsel for the informant.

This is an application for bail under section 439 of Cr.P.C. in connection with Aska P.S. Case No.02 of 2016 corresponding to S.T. case No. 28 of 20206 pending in the Court of learned Addl. Sessions Judge, Aska for alleged commission of offences under sections 450, 376-D, 376(2)(n), 342, 323, 506, 34 of the Indian Penal Code read with section 25(1-B) of the

// 2 // Arms Act.

It is a case of gang rape and the victim has supported the prosecution case.

In view of the nature and gravity of the accusation, while not inclining to release the petitioner on bail but taking into account the period of detention of the petitioner in judicial custody, I direct the learned trial Court to conclude the trial, if possible by the end of December 2022. The petitioner is at liberty to renew the prayer for bail, if the trial is not concluded within the aforesaid period.

The BLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.

Let the order be communicated to the Court concerned forthwith.
