This matter is taken up through hybrid mode.

Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking direction to the opposite parties to refund the Additional Performance Security amount of Rs.24,06,768.61 and to direct the opposite parties to close the contract namely, KANDRA MIP in Joda due to not handing over the unobjectionable site within time.

Learned counsel for the petitioner contended that pursuant to the order passed by this Court dated 17.02.2021 in W.P.(C) No. 413 of 2021, the petitioner has filed a representation before opposite party no.2 on 13.06.2021 under Annexure-6, but the same is still pending consideration.

This being the limited grievance of the petitioner, this Court without expressing any opinion on the merits of the case, disposes of the

writ petition directing the opposite party no.2 to take a decision on the representation filed by the petitioner vide Annexure-6, taking into consideration Annexure-7 and pass appropriate order in accordance with law, within a period of three months from the date of production of certified copy of this order by the petitioner.
