This matter is taken up through virtual/physical mode. 2.

The Original Application No. 69 (S) of 2016 was filed before the Odisha Administrative Tribunal, Circuit Bench, Sambalpur. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAS) No. 66 of 2016.

The Petitioner working as a Forest Guard under the Divisional Forest Officer, Sambalpur (KL) Division, Sambalpur preferred this writ petition challenging the order dated 01.06.2016 passed by the Divisional Forest Officer (K.L.) Division, Sambalpur seeking to recover an amount of Rs.22161/-.

Pursuant to the notice to the Opposite Parties, counter has been filed by Opposite Parties. In the counter, it has been specifically mentioned that the Home Department has published the list of Police Station and Blocks which were Naxal prone areas. The working place of the Petitioner is not enlisted as naxalite affected Blocks. Therefore, the incentive

// 2 // allowance provided to the Petitioner was directed to be reversed.

In view of the specific stand of the Opposite Parties justifying the issue of order dated 01.06.2016 vide Annexure-2, the writ petition does not deserve consideration. 6.

The interim order passed, if any, stands vacated. 7.

In view of the above, this writ petition stands dismissed.
