1. This matter is taken up through hybrid mode. Order No.

2. Heard Mr. A.K.Nath, learned counsel for the Petitioner and Miss.S.Mishra, learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 24th August, 2021 in connection with Banarpal P.S.

Case No.333/2020 corresponding to G.R. Case No.40/2021 pending in the court of learned J.M.F.C., Banarpal, for the alleged commission of the offence under Section 395 of I.P.C.

4. The allegation against the Petitioner is that he along with two others came in a motor cycle being armed with deadly weapons and snatched away cash of Rs.59,555/- and other articles from the informant by threatening him.

5. It is submitted by the learned counsel for the Petitioner that similarly placed co-accused persons have already been released on bail by this Court in BLAPL Nos.8400/2021 and 8709/2021, copies of which are filed in Court today.

6. Considering the above facts, the materials on record and the period of detention already undergone, I am inclined to allow the prayer for bail.

7. Let the Petitioner- Soumya Ranjan Garnaik be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the trial court on each date of posting of the case without fail.

8. The BLAPL is disposed of.

9. Urgent certified copy of this order be granted on proper application.
