Petitioner claims itself to be a tenant over a mortgaged immovable property offered as a collateral security for loans availed by Paidisetty Dilip Kumar/Opposite Party No.2 from State Bank of India. 2.

By filing the present Writ Petition, challenge has been laid to the Auction Sale Notice dated 20th September, 2022, whereby the property in possession of the petitioner was to be put for auction sale on 27th October, 2022.

At the time of hearing, learned counsel for the petitioner prays for permission to withdraw the present Writ Petition as not only the auction has failed on the said date for want of any intending bidders, but also realizing that the petitioner (being a

// 2 // tenant) has no right to challenge the Auction Sale Notice.

In view of the above, the present Writ Petition stands dismissed as withdrawn.
