1. Heard learned counsel for the Petitioners and learned counsel for the State.

2. This is an application for bail U/s.438 Cr.P.C. filed by the Petitioners in apprehension of arrest for their alleged involvement in the offences U/s. 51(1) of Wild Life Protection Act, 1972.

3. Learned counsel for the Petitioners submits that the co-accused persons have since been released upon surrendering on bail before the trial court by virtue of the order passed in ABLAPL No. 13348 of 2022.

4. Keeping in view the above submission of the parties and having gone through the nature of allegations as emerged from the materials on record and further the circumstances appearing, the seriousness and gravity of the offences, considering the fact that the co-accused persons have since been released on bail, it is directed

// 2 // that in the event the Petitioners surrender and move for bail in connection with 2(b)CC Case No.09 of 2022 arising out of O.R No.37 of 2022-23 giving rise to P.R No.04 of 2022-23 pending in the court of learned S.D.J.M., Pallahara within a period of three weeks' hence, they shall be admitted to bail on such terms and conditions as would be deemed just and proper by the said court with further conditions that:- (i). The Petitioners shall cooperate with the investigation and appear before the I.O. as and when required by the I.O; (ii). They shall not indulge in similar nature of offence while on bail.

(iii). They shall appear before the court below on each and every date fixed.

Violation of any of the conditions shall entail cancellation of bail of the Petitioners.

5. The ABLAPL is disposed of accordingly.
