1. This matter is taken up through hybrid mode.
2. Heard Mr. Mahes Das, learned counsel for the Petitioner and Miss.S.Mishra, learned Addl. Standing Counsel for the State.
3. The Petitioner is in custody since 15th May, 2021 in connection with Tumudibandha P.S. Case No.29/2021 corresponding to C.T. Case No.34/2021 pending in the court of
// 2 // learned J.M.F.C., Tumudibandha for the alleged commission of the offence under Sections 457/458/395/397/120-B of I.P.C.
4. The allegation is that on the night of occurrence the Petitioner along with several other persons came to the liquor shop belonging to the informant and took away liquor worth Rs.6,00,000/-, a scooty and one mobile phone. It is submitted that the other co-accused persons have already been released on bail by this Court in BLAPL No.4600/2021, copy of which is enclosed to the present bail application.
5. Having regard to the submissions made, the materials on record, the period of detention already undergone and particularly the fact that all other co-accused persons, who stand on the similar footing, have been released on bail, I am inclined to allow the prayer for bail of the Petitioner.
6. Let the Petitioner- Richard Nayak @ Tuel @ Roni be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the trial court on each date of posting of the case without fail.
7. Urgent certified copy of this order be granted on proper application.
