Heard learned counsel for the petitioners and learned Addl. Standing Counsel.

The petitioners are in custody since 06.10.2021 in connection with Basta P.S.
Case No.291 of corresponding to Special Case No.273 of 2021 pending in the Court of learned Sessions judge-cum- Special Judge, Balasore for the alleged commission of offence under Sections 21(b)/29 of NDPS Act, 1985.

Having regard to the submissions made, the materials on record, the period of detention already undergone and the fact that the seized contraband (brown sugar) is less than commercial quantity, being 121 grams, I am inclined to allow the prayer for bail. Let the petitioners be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that
they shall personally appear before the trial court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.

Issue urgent certified copy as per rules.
