Heard learned counsel for the petitioner and learned Standing Counsel for School & Mass Education Department.

The petitioner has challenged the order dated 09.09.2020 issued by the State Government in School and Mass Education Department and prays for revival of the order dated 01.08.2019 and also to direct the opposite parties to issue appointment order in her favour under Rehabilitation Assistance Scheme within a stipulated time.

Mr. Jena, learned Standing Counsel for School & Mass Education Department contended that the legality of the very same order dated 09.09.2020 has already been decided in the case of Bindusagar Samantaray v. State of Odisha (S&ME Dept.) & others, 2021 (III) ILR-Cut-307 and as such need not be required to be adjudicated again. He further contended that the case of the petitioner at best may be consider in the light of the judgment passed in the case of Ritanjali Giri @ Paul v. State of Odisha (School & M.E. Deptt.) & others, 2016 (I) ILR-1162.

In view of this above, this Court is not inclined to quash the order dated 09.09.2020, however directs the authorities to consider the case of the petitioner in the light of the decision rendered in the case of Ritanjali Giri (supra), within a period of three months from the date of communication of the order. 6.
