This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned Counsel for the State.

The present writ petition has been filed by the petitioner challenging the 2nd show cause notice issued in a Disciplinary Proceeding on 22.8.2016. Even though notice of the Writ Petition was issued on 10.11.2016, but there is no interim order restraining the Disciplinary authority from proceeding with the matter. However, learned counsel for the petitioner submitted that the proceeding till date has not yet been finalized because of the pendency of the writ petition.

In view of that, this Court while disposing of the Writ Petition permits the petitioner to file his reply to the second show cause within a period of three weeks from today. It is further observed that if any such reply to the 2nd show cause is filed within the aforesaid time period, the proceeding initiated against the petitioner be finalized within a further period of four weeks.

However, it is observed that if no such reply is filed within the aforesaid time period, the Disciplinary authority is free to proceed with the matter and pass appropriate order.

With the aforesaid observation and direction, the Writ Petition is disposed of.
