Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 29.09.2021 in connection with Kendrapara P.S. Case No. 1414 of 2021 pending in the court of learned S.D.J.M., Kendrapara for the alleged commission of offence under Sections 457/380 of IPC. 4.

It is alleged that the petitioner is a receiver of the stolen property. It is submitted that all the co-accused persons, who are said to have committed the crime, have been released on bail by the Court below. Copies of such bail orders have been enclosed to this application.

Considering the submissions made, the materials on record, the period of detention already undergone and the fact that the co-accused persons have already been released on bail, I am inclined to allow the prayer for bail.

Let the petitioner be released on bail on such terms and

conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

Issue urgent certified copy as per rules.
