Heard learned counsel for the petitioners and learned Addl. Standing Counsel for the State.

The petitioners are in custody since 26.09.2021 in connection with Chhendipada P.S. Case No. 454 of 2021 corresponding to G.R. Case No. 760 of 2021 pending in the court of learned J.M.F.C., Chhendipada Kendrapara for the alleged commission of offence under Sections 457/380/307/294/506/34 of IPC.

The allegation is that on 25.09.2021 the petitioners committed theft of some articles including cash of Rs. 2000/- from the shop belonging to the informant and were caught in the process, whereupon they attempted to assault the informant and another person who is nearby shop owner.

Having regard to the submissions made, materials on record and the period of detention already undergone I am inclined to allow the prayer for bail. Let the petitioners be
released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition that they shall personally appear before the trial court on each date of posting of the case without fail. 6.
Issue urgent certified copy as per rules.
