1. Heard learned counsel for the Petitioners and learned counsel for the State.
2. This is an application under Section 438 Cr.P.C. filed by the Petitioners for anticipatory bail his alleged involvement in the offences punishable under Sections 143/341/506/287/149, I.P.C.
3. Keeping in view the submissions of the parties and having gone through the nature of allegations as emerged from the materials on record, and further the circumstances appearing and the seriousness and gravity of the offences, it is directed that in the event the Petitioners surrender in connection with G.R. Case No.2503 of 2022 arising out of Tangi P.S. Case No.196 of 2022 pending in the Court of learned J.M.F.C. (R), Cuttack within a period of three weeks' hence and move for bail, they shall be allowed to go on bail on such terms and conditions as would be deemed just and proper
// 2 // by the said court with further conditions that the Petitioners shall file an undertaking before the learned court concerned that they shall not squat in front of the gate of the factory premises within a radius of three hundred meters obstructing the ingress and egress of the employees, staff and officers of the Establishment or sabotage in any manner against the Authority / Management / Employer of the Kapilas Cement Manufacturing Works, Dalmia (the Company in question), while on bail. Violation of the terms and condition and the undertaking shall entail cancellation of the bail without further reference.
4. The ABLAPL is disposed of accordingly.
