01. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard learned counsel for the Petitioner and learned counsel appearing for the State-Opp. Parties.

3. The Petitioner has filed the present writ Petition with the following prayer:- "i. To declare the proceeding of the selection committee meeting held for recruitment year 2012 for the post of ORS through promotion considering the ineligible person violating the statute as illegal, arbitrary and unconstitutional and direct the respondent no. 1 to convene a review selection board considering the eligible person only as per Rule and strictly following the principle of merit cum suitability with due regard to seniority and in the event the applicant will be found suitable to grant him all consequential service benefits in the post of ORS (Group-B) w.e.f. the orders as at Annexure-5.

// 2 // ii. To further direct the Respondent No. 1 to modify the appointment order as at Annexure-5 in accordance to the decision of the review selection Committee.

iii. To grant any relief/reliefs as deemed fit and proper."

From the pleadings made, it is apparent that the Petitioner prior to filing the present writ Petition has not approached the Authority claiming extension of the benefit as prayed for in the Writ Petition. Accordingly, while disposing the writ Petition the Petitioner is permitted to make a detailed application before O.P. No.1 within a period of three (3) weeks claiming extension of the benefit as prayed for in the writ Petition.

5. It is observed that if any such application is filed within the aforesaid period, the said O.P. No. 1 shall take a lawful decision on the same by giving a personal hearing to the Petitioner within a period of three (3) months.
