This matter is taken up through Hybrid Mode.

Order No 2.

Heard learned counsel for the Parties.

It is submitted that during pendency of this matter before this Court, the Petitioner has been acquitted in the criminal proceeding.

It is further submitted that on the self-same charges, the disciplinary proceeding is continuing as against the Petitioner. It is submitted that since the Petitioner has been acquitted from the criminal cases, he may be granted liberty to move the authority for passing of an appropriate order with regard to continuance of said disciplinary proceeding as against the Petitioner.

Taking into account such submission made by Mr. Apat, learned counsel for the Petitioner, the Writ Petition is disposed of by giving liberty to the Petitioner to move appropriate application before the Opposite Party within a period of two weeks from today.

It is observed that if any such application is filed within the aforesaid time, the said Opposite Party shall take a lawful decision on the same and by taking into account the order of

// 2 // acquittal passed in the criminal proceeding. The entire exercise shall be completed within a period of two months from the date of receipt of such application.

With the aforesaid observations and directions, the WPC(OAC) stands disposed of.
