Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 09.08.2021 in connection with Talsari Marine P.S. Case No.27 of 2017 corresponding to C.T. Case No.609 of 2017 pending in the court of learned J.M.F.C., Jaleswar for the alleged commission of offence under Sections 498-A/304-B/302/34 of IPC read with Section 4 of DP Act.

It is submitted that there is absolutely nothing against the present petitioner either in the FIR or in the charge sheet. The name of the petitioner also does not find place in the FIR and all the allegations are directed against the mother-in-law and elder sister-in-law of the deceased, who are said to have subjected the deceased to cruelty in connection with demand for further dowry. It is further submitted that the petitioner is

working as a helper to a cook in a hotel at Goa. 5.

Learned Addl. Standing Counsel has opposed the prayer for bail but fairly submits that neither the FIR nor the charge sheet mentions the name of the husband.

Having regard to the submissions made, the materials on record, the period of detention already undergone, and particularly the fact that nothing specific has been attributed to the present petitioner by the informant or in the charge sheet, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose. 7.

The BLAPL is disposed of.
