This matter is taken up through Hybrid Arrangement Order No.

Heard learned counsel for the Appellant and learned counsel for the State-Respondent. Perused the Case Diary, F.I.R. and statement of the witness.

This appeal has been filed by the Appellant challenging the order dated 24.09.2021 passed by the learned Sessions Judge-cumJudge (Special Court), Sambalpur in Special G.R. No.18/2021, arising out of Thelkoli P.S. Case No.74 of 2021, for commission of alleged offence under Sections 147/148/294/302/149 of I.P.C. and Sections 3(1)(r)(s)/3(2)(v)(va) of the S.C. & S.T. (POA) Act, rejecting the bail application filed by the Appellants. 4.

Learned counsel for the State submits that charge-sheet has been filed in the case awaiting commitment of the matter. At this

// 2 // stage, learned counsel for the Appellant does not want to press this appeal with liberty to move before the trial court after commitment of the matter. It is further submitted that some of the co-accused persons have been released on bail by this Court. 5.

In such view of the matter, the Appellant is permitted to withdraw the appeal with liberty to file fresh application after commitment of the case before the trial court. In such event, the same shall be considered keeping in view the fact that some of the co-accused persons have been released on bail. 6.

With the aforesaid observation, the CRLA stands disposed of as withdrawn with liberty as prayed for.
