1. Learned counsel for the Petitioners and learned counsel for the State.
2. By means of this application, the Petitioners seeks for anticipatory bail under Section 438 Cr.P.C. in connection with Athagarh P.S. Case No.247 of 2022 corresponding to C.T. Case No.566 of 2022 pending in the file of learned S.D.J.M., Athagarh.
3. The Petitioners alleged to have been involved in the offences under Sections 341/323/324/307/354-B/294/506/34 IPC. There is a clear indication not only in the F.I.R. but also in the injury report that the injured is struggling for life pursuant to the assault made on him in the incident. The name of the accused appears in the record though not the specific assault in qiestion. Be that as it may, keeping in view the seriousness of the allegation, the gravity and the fact that the Petitioners along with others in furtherance to their
// 2 // common intention committed the crime to do away with the life of the injured, are not entitled to the bail in anticipation of their arrest.
4. Therefore, this Court is not inclined to grant anticipatory bail, which is accordingly dismissed.
