Order No 2.

Heard learned counsel for the Petitioner and learned counsel for the Opposite Parties.

The Petitioner has filed the present Writ Petition with the following prayer:- "(i) The Hon'ble Tribunal be pleased to admit and allow the O.A.

(ii) The Hon'ble Tribunal be pleased the respondents to regularize / approve the service period of the applicant from the date of initial appointment i.e. from 02.04.1986 instead of 01.07.1988 by counting the said service period for all purposes with all consequential service and financial benefits within a time bound period for the interest of justice.

(iii) The Hon'ble Tribunal may be pleased to pass any order (s) / direction (s) as deems fit and proper for the interest of justice".

Considering the submission made and without expressing any opinion on the merits of the case, the Petitioner is directed to make a fresh representation before the Opposite Party No.2 by enclosing all the relevant

// 2 // documents and citations in support of his claim, if any, within a period of three weeks hence.

It is observed that if such a representation is filed within the aforesaid period, the Opposite Party No.2 shall take a decision on the same taking into account the communication made by Office of the Headmaster School and Mass Education Department under Annexure-5. 6.

Since the Petitioner has retired in the meantime, the Opposite Party No.2 is directed to take a decision within a period of two months from the date of such representation. 7.

With the aforesaid observations and directions, the Writ Petition is disposed of.
