Dilu @ Dilip Behera v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
BLAPL No. 9391 of 2021 Dilu @ Dilip Behera ...
Petitioner Mr. B. Pasayat, Advocate - Versus - State of Odisha ...
Opposite Party Mr. P. Tripathy, Addl. Standing Counsel
CORAM:
JUSTICE SASHIKANTA MISHRA ORDER_ 07.01.2022 1.
This matter is taken up through hybrid mode.
Order No.
1.
2.
Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.
3.
It is submitted by learned counsel for the petitioner that the co-accused has already been released on bail by this Court. 4.
Having regard to the nature of allegations leveled against the petitioner, which prima facie reveals that he is the master mind of the entire episode and it is observed that the coaccused persons, who are released on bail, do not at all stand on the same footing as that of the petitioner, inasmuch as there are specific allegation against the petitioner which clearly suggests that he had conspired to do away the life of the deceased, I am not inclined to allow the prayer for bail, which is accordingly rejected. It shall however be open to the petitioner to renew his prayer after examination of some material witnesses in the case.
5.
The BLAPL is therefore disposed of.
