2. Heard Mr. C.S. Panda, learned counsel for the Petitioner and Mr. M.K. Balabantaray, learned A.G.A
3. The Petitioner has filed the present writ petition for the following relief.
Direct the respondents to issue appropriate order of appointment in a Class III post on regular basis in suitable modification of the order of appointment as at Annexure-8 by further declaring that the decision of respondents as at Annexure-8 and other related decisions are illegal arbitrary and unconstitutional being violative to the statutory provisions.
4. This Court after hearing the parties when held that the prayer as made is not entertainable, Mr. Panda submits that he may be permitted to withdraw the writ petition with liberty to make an application by challenging the appointment of the petitioner as against a Group-D post on contractual basis, even though regular vacancies were available.

5. In view of such submission of the learned counsel for the petitioner, the Writ Petition is dismissed as withdrawn with the liberty as prayed for.
