JUSTICE M.S.SAHOO Order No.

ORDER

7.7.2022

1. 1. This matter is taken up through hybrid mode.

2. The writ petition has been registered before this Court on 27.8.2021 after the Original Application was transferred upon abolition of the learned Odisha Administrative Tribunal, Bhubaneswar.

3. On perusal of the available order-sheets of the learned Tribunal it is indicated that notices were issued on 20.11.2015. Thereafter it was never taken up/pursued nor there is any further pleadings by any of the parties.

4. The O.A. was filed before the learned Tribunal in the year 2015 by the petitioner then working as Assistant Teacher for grant of RACP (Revised Assured Career Progression) from the date of his initial joining in service instead of being granted from the date of acquiring CT qualification.

5. It is submitted by learned counsel for the petitioner that she has no up-to-date instruction to pursue the matter at present.

6. Learned Standing Counsel referring to the averments made in the writ petition, submits that considering the nature of grievance, nothing would survive at present after lapse of seven years when the subsequent pay revisions have happened.

7. Having heard learned counsel for the parties, the writ petition is disposed of for lack of up-to-date instruction on behalf of the petitioner to pursue the matter at present granting liberty to revive the petition within sixty days for any surviving cause of action.
