Challenging the Office Order bearing No.XIII-3/1690/Ex.,(con.) dated 1st March, 2016 issued by the Excise Commissioner suspending the petitioner, Junior Clerk in the District Excise Office, Bhadrak, writ petition has been filed with a prayer to quash the said Office order and the petitioner also prayed to quash communication dated 19th February, 2016 issued by the Collector and District Magistrate, Bhadrak directing withdrawal of the petitioner and posting Senior Clerk in District Excise Office, Bhadrak.

None appeared for the petitioner.

Perusal of the record shows that though notice was issued requesting filing of counter affidavit, no interim protection has been given in favour of the petitioner. 4.

Shibani Shankar Pradhan, learned Addl.

Government Advocate appearing for the State at the time of hearing today, submitted that by efflux of time the matter has been rendered infructuous and the Disciplinary proceeding would have been proceeded substantially by now.

In such view of the matter, the writ petition is dismissed as infructuous.
