This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.1449 of 2022, pending in the file of learned J.M.F.C., Chandikhole, arising out of Balichandrapur P.S. Case No.317 of 2022, for commission of alleged offences under Sections 498(A)/294/323/506/420/406/34 of IPC and 4 of D.P. Act and is in custody since 24.09.2022. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Assistant Sessions Judge, Chandikhole by order dated 18.10.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that the petitioner is in custody since 24.09.2022, further continuance of the petitioner in custody is not warranted.

Learned counsel for the State opposes the prayer for bail relying on the order of rejection.

Taking into account the nature of allegations and period of custody, this Curt directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
